These Terms of Service ("Terms") govern your use of OnTrack, an accountability application operated by Sesodia Technologies Limited ("we", "us"), a company registered in England and Wales under company number 16782991, with its registered office at New College, Holywell Street, Oxford OX1 3BN. In these Terms, "Services" means the OnTrack mobile application, our website, and all associated software and systems. Together with our Privacy Policy, these Terms form a binding agreement between you and us.
Please read these Terms carefully. By accessing or using the Services, you agree to be bound by them. If you do not agree to these Terms, you must not use the Services.
1. Who Can Use OnTrack
You must be at least 13 years old to use the Services. If you are under 18, we recommend that a parent or guardian reviews these Terms with you.
You may use the Services only if you are a natural person. The Services are not made available for use by bots, scripts, or other automated systems.
2. Your Account
In creating and holding an OnTrack account, you agree to:
- Provide accurate and complete information
- Keep your account credentials secure
- Notify us without delay if you suspect unauthorised access to your account
- Accept responsibility for all activity carried out under your account
3. Accountability Partners
The Services allow you to connect with accountability partners, being users who are able to view your check-in activity. By adding an accountability partner, you authorise the disclosure of your check-in data to that person.
Joining a group has the same effect. On joining, an accountability partner connection is created between you and every other member of that group, in both directions and without a separate approval step, and you authorise the disclosure of your check-in data to each of them. Leaving the group does not end those connections; they must be removed individually.
You determine who may view your activity, and may add or remove accountability partners at any time within the Services.
Every OnTrack account has an invite link, created automatically, which you can share to add partners or invite people to a group. Anyone who opens an invite link can see certain profile information, such as your name, profile picture, and streak, even without an OnTrack account. See our Privacy Policy for details. By using the Services you accept that this information is accessible to any person holding your link, and you should share it only with people you are content to have access to it.
Find Friends is an optional feature. Where you elect to use it, you may provide your phone number and permit the Services to check your contacts in order to identify people already known to you on OnTrack. You may disable this feature and remove your number at any time. You must not use it to send invitations to persons unknown to you.
4. Check-ins and Content
"Content" means check-in photos, profile photos, and any other information you share through our Services.
You are responsible for the Content you share, and you warrant that:
- You hold the necessary rights to share any Content you upload
- Your Content does not infringe any applicable law or these Terms
You retain ownership of your Content. By sharing Content through the Services, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and distribute that Content as necessary to operate the Services as described in these Terms and our Privacy Policy. That includes displaying it to your accountability partners and the members of groups you join, displaying limited profile information to anyone who opens an invite link you have shared, and permitting our service providers to process it on our instructions.
This licence ends when you delete the Content or your account, except that it continues for Content that remains part of another user's record, such as a comment or message you sent them, as described in our Privacy Policy.
5. Acceptable Use
You agree that you will not:
- Harass, abuse, or otherwise harm other users
- Share Content that is unlawful, or that we reasonably consider to be offensive, abusive, or otherwise inappropriate, having regard to the purpose of the Services and the users likely to see it
- Attempt to access another user's account without authorisation
- Access the Services by automated means without our prior consent
- Interfere with, disrupt, or impair the operation of the Services
We reserve the right to suspend or terminate any account that breaches these Terms.
6. Pricing
The Services are provided free of charge. All features are available at no cost, and there are no in-app purchases or subscriptions.
7. Intellectual Property
The Services, including the OnTrack name, logo, and design, are owned by Sesodia Technologies Limited and protected by intellectual property law. Nothing in these Terms confers any right to use our branding without our prior written permission.
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the OnTrack application for its intended purpose.
8. Ending Your Use of OnTrack
Account Deletion: You may delete your account at any time within the in-app settings. On deletion, your personal data is permanently removed in accordance with our Privacy Policy.
Suspension: We may suspend or terminate your account where you breach these Terms, or where your use of the Services is liable to harm other users or our business.
Inactive Accounts: We may delete accounts that have remained inactive for an extended period. We will give you notice before doing so.
9. Disclaimer and Limitation of Liability
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, secure, or free from error.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Nothing in these Terms affects your statutory rights as a consumer.
Subject to the paragraph above, we are not liable for: losses that were not reasonably foreseeable to both you and us when you accepted these Terms; losses that were not caused by our breach; or any loss of profit, revenue, business, or business opportunity. The Services are provided free of charge, and our total liability to you for all claims arising out of or in connection with these Terms shall not exceed £100.
OnTrack is a tool for accountability and motivation. We do not provide medical, fitness, or health advice, and nothing in the Services should be relied upon as such. You should consult a suitably qualified professional before beginning any training programme.
10. Changes to These Terms
We may amend these Terms from time to time, to reflect changes to the Services, to our business, or to legal or regulatory requirements. Where changes are material, we will notify you through the Services or by email, and we will give you reasonable notice before they take effect. Previous versions are available from us on request.
Your continued use of the Services after the changes take effect constitutes acceptance of the amended Terms. If you do not agree to them, your remedy is to stop using the Services and delete your account, which you may do at any time and at no cost.
11. Governing Law
These Terms are governed by the laws of England and Wales. You may bring proceedings in respect of these Terms in the courts of England and Wales or, if you live elsewhere, in the courts of the country in which you live where the law gives you the right to do so. Nothing in this clause deprives you of the protection of the mandatory rules of the law of the country in which you live.
12. General
Severability. If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed. The remaining provisions continue in full force.
Entire agreement. These Terms and our Privacy Policy form the entire agreement between you and us in relation to the Services, and replace any earlier agreement or understanding between us on that subject. Nothing in this paragraph limits liability for fraud or fraudulent misrepresentation.
Assignment. You may not assign or transfer your rights under these Terms. We may assign or transfer ours to a member of our group, or to a purchaser of our business, provided this does not reduce the protection given to you under these Terms.
No waiver. If we do not enforce a right under these Terms, or delay in doing so, that is not a waiver of that right.
Third parties. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of them.
